Welcome to Otus. This Privacy Policy explains how Otus AI Pte. Ltd. ("Otus", "we", "us", or "our") collects, uses, discloses, and safeguards your information when you access and use our website (https://otus.build/) and our web application, mobile application, APIs, and related features (collectively, the "Service").
By accessing or using the Service, you acknowledge that your use is also governed by our Terms of Service, and you agree to our collection, storage, use, and disclosure of your personal information as described in this Privacy Policy.
2. Data Controller and Data Processor
We process personal data in accordance with the Singapore Personal Data Protection Act 2012 (PDPA).
Data Controller: If you subscribe on behalf of a company or entity (the "Organisation"), the Organisation acts as the data controller and determines the purposes and means of processing personal data. The Organisation is responsible for ensuring all personal data processed through the Service is collected on a lawful basis.
Data Processor: Otus acts as a data processor, processing personal data collected through the Service solely to the extent necessary to provide the Service to you.
3. Information We Collect
We collect information to provide and secure our Service, including:
Account Registration Data: To register for the Service, you must create an Account. We collect your accurate, complete, and current registration information, such as your email address. We may also collect verification information to confirm your identity and ensure account security.
Customer Data and User Content: We collect the materials you upload to or create within the Service. This includes photos, floor plans, documents, remarks, annotations, and other data submitted by you or your team members.
Billing Information: For paid subscription plans, you must provide payment details to authorise us, or our payment processing service, to charge applicable fees.
4. How We Use Your Information
We do not sell or license your User Content to third parties. We use your information solely for the following purposes:
To provide, operate, and maintain the Service, including organising site photos, generating PDF progress reports, and managing team access.
To process your transactions, manage your Subscription, and send billing notices.
To verify your identity, secure your Account, and provide customer support.
To improve our Service using any suggestions, ideas, or feedback you provide to us.
5. How We Share Your Information
We may share your information in the following limited circumstances:
With Your Organisation: User Content uploaded by team members belongs to the Organisation. Organisation Admins control access to that content and manage team member permissions.
Service Providers: We host Customer Data on infrastructure provided by Amazon Web Services (AWS) in accordance with AWS's security certifications and compliance programmes.
Third-Party Integrations: If you use Third-Party Services connected to Otus, your data may be transferred to them subject to their own terms and privacy policies.
Business Transfers: We may transfer your information to a successor entity resulting from a merger, acquisition, or sale of all or substantially all of our assets.
Legal Obligations: We may disclose your information if required to do so by a court order, law, or to legal or financial advisors.
6. Data Security
We implement and maintain administrative, physical, and technical safeguards to protect Customer Data, including:
Encryption: Customer Data is stored in transit using TLS 1.2 or higher, and at rest using AES-256 or equivalent.
Access Controls: Access to Customer Data is limited to authorised Otus personnel strictly on a need-to-know basis.
Assessments: We conduct regular security assessments, vulnerability testing, and maintain incident response procedures.
7. Data Retention and Deletion
Active Accounts: We retain your User Content while your account is active and as necessary to provide the Service.
Export Period: Upon expiration or termination of your Subscription, you have a 30-day Export Period to download your Customer Data, including photos, floor plans, and metadata.
Deletion: Following the 30-day Export Period, we will delete your Customer Data within 30 days, except where retention is required by law.
Backups: Backup copies of deleted data may persist for up to an additional 30 days.
User Requests: You may request deletion of specific User Content at any time through the Service.
8. Your Rights and Choices
You have control over your data. You may terminate your account at any time by following the account closure instructions in the Service. If you are a team member within an Organisation Account, please direct requests to access, correct, or delete your personal data to your Organisation's Administrator, who manages access and controls the data.
9. Children's Privacy
You must be of the age of majority according to your applicable law to use the Service. We do not knowingly collect information from minors. If you are under the age of majority, you may only use the Service under the guidance of a legal guardian who has read and agreed to the Terms on your behalf.
10. Changes to This Privacy Policy
We may update this Privacy Policy from time to time for valid reasons, such as adding new features or meeting legal requirements. When we make material changes, we will provide you with notice by displaying a prominent notice within the Service or by sending an email at least 14 days before the changes take effect. Your continued use of the Service constitutes acceptance of the updated terms.
